THE AGREEMENT:
The use of this website and services on this website provided by linkpit.ch LLC (hereinafter referred to as “Company”) are subject to the following Terms & Conditions (hereinafter the “Agreement”), all parts and sub-parts of which are specifically incorporated by reference here. 19) LIMITATION ON LIABILITY
The Company’s liability is limited to the greater of $100 or the amount paid by You to the Company in the last six months. We are not liable for indirect or consequential damages.
20) GENERAL PROVISIONS
a) Language: English only.
b) Jurisdiction & Law: This Agreement is governed by the laws of the State of California, without regard to its conflict of law provisions. Any legal matters must be resolved in Los Angeles County, California.
c) Arbitration: Disputes not resolved amicably will be settled by binding arbitration in Los Angeles County, CA. Each Party pays its own fees. IP disputes are excluded from arbitration.
d) Assignment: You may not transfer this Agreement without written consent from the Company.
e) Severability: If any clause is found unenforceable, the rest shall remain valid.
f) No Waiver: Our failure to enforce any provision does not waive future enforcement.
g) Headings: For reference only.
h) No Agency: Nothing in this Agreement creates a partnership, joint venture, or agency.
i) Force Majeure: We are not liable for delays or failures due to causes beyond our control.
j) Electronic Communications: Communication via email is permitted under this Agreement.
